Is it legal to sell CBD in France?
In France, it is entirely legal to sell and consume CBD. This molecule should not be confused with THC (tetrahydrocannabinol), which remains a psychoactive substance whose sale and consumption are prohibited in France.
Whilst CBD can circulate freely in France, it is important to note that its sale is nevertheless subject to very strict regulations. French legislation regarding CBD is governed by two pieces of legislation, the provisions of which must be strictly adhered to in order to be authorised to sell cannabidiol in France:

ArticleR 5132-86 of the Public Health Code, dating from 2004 and updated in 2013, prohibits “the production, manufacture, transport, import, export, possession, the supply, transfer, acquisition or use” of cannabis and its derivatives, without, however, defining in detail which cannabinoids are concerned (THC, CBD, CBG, etc.).

The decree of 22 August 1990, amended by Decree No. 2013-473 of 5 June 2013 – Art. 1, suggests that “the cultivation, import, export and industrial and commercial use (fibres and seeds) of varieties of Cannabis sativa L. meeting the following criteria are authorised:

only the stems and seeds may be used;

the hemp variety is authorised and appears on a list included in the law (26 varieties to date).

Which entities are authorised to sell CBD in France?
In France, several types of businesses are authorised to sell CBD. These include, in particular:

Specialist shops and herbalists
Specialist shops and herbalists are authorised to sell a wide range of CBD-based products (sublingual oils, capsules, flowers, food products, etc.). However, they are only permitted to operate if they sell products derived from plants approved by the government and in compliance with the legislation mentioned above.

Pharmacies and parapharmacies
Since January 2022, pharmacies and parapharmacies have also been authorised to sell CBD-based products. However, their product range remains fairly limited. To define these restrictions, the DGS (Directorate General for Health) relies on the nomenclature provided by MIDELCA. Consequently, pharmacies are not permitted to offer CBD flowers, pet food, oils or food supplements derived from a plant not approved by the European Food Safety Authority (EFSA), in accordance with the Novel Food Regulation.

Tobacco shops or e-cigarette shops.
Tobacco shops and e-cigarette shops are also authorised to sell CBD in France. However, like pharmacies, they offer a more limited range than a specialist shop. It is still very easy to find CBD-based e-liquids or sweets in this type of shop.
Can private individuals sell CBD in France?
In theory, anyone can sell CBD, provided that the legal framework (both commercial and relating to the distribution of CBD) is complied with.
How do you sell CBD?
To sell CBD, it is essential to open a shop or set up an online store. Although the sale of cannabidiol is not subject to specific administrative procedures, you will still need to register your business with the authorities.
The second crucial step is to find a supplier who complies with French legislation. To do this, ensure that they manufacture their products from plants approved by the French government and that the CBD is extracted from the stems and roots of the plant.
